1. FUTURE DAMAGE

Advanced Pest Innovations LLC is not responsible for and does not guarantee against present or future damage to the building or contents, nor does it provide for the repair or replacement thereof. This agreement does not cover the control of termites, fungus, beetles, or any pests not specified herein. This plan does not guarantee, nor does Advanced Pest Innovations LLC represent, that covered insects will not return to the property.

2. PURCHASER’S RESPONSIBILITY

Your cooperation is essential to achieve the most effective results from Advanced Pest Innovations LLC’s service. If conditions conducive to pest breeding and harborage are reported in writing by Advanced Pest Innovations LLC and are not remedied by you, Advanced Pest Innovations LLC cannot guarantee satisfactory service. Failure to correct reported conditions as required will void all guarantees under this agreement. Additional treatments necessitated by unaddressed conditions will incur extra service charges payable by the customer. The customer is also responsible for collections fees.

3. NOTICE OF CLAIMS / ACCESS TO PROPERTY

Any claims arising from this agreement must be submitted in writing by the purchaser to Advanced Pest Innovations LLC during the term of this agreement. Purchaser must allow Advanced Pest Innovations LLC access to the property as necessary for services under this agreement. Failure to provide timely access will result in automatic termination of this plan.

4. NON-PAYMENT / DEFAULT

Advanced Pest Innovations LLC’s obligations under this agreement are contingent upon full payment of the initial charge and all regular service fees. Failure to make timely payments will cancel this plan in its entirety, releasing Advanced Pest Innovations LLC from liability, and all amounts paid will become the property of Advanced Pest Innovations LLC. Any unpaid balances not paid within 30 days of receipt are subject to a late fee of no less than 5%, which will accrue monthly until the balance is paid in full.

5. DISCLAIMER

A.     FORCE MAJEURE

Advanced Pest Innovations LLC shall not be liable if its performance is prevented by delays in transportation, shortages of fuel or materials, strikes, embargoes, fires, floods, quarantine restrictions, earthquakes, hurricanes, or any other acts of God or events beyond its control. Service charges may be adjusted in response to such events.

B.     OTHER INSECTS / ORGANISMS

This agreement provides for treatment and re-treatment of pests specified herein. It does not cover subterranean termites (Reticulitermes spp., Heterotermes spp., Coptotermes spp.), drywood termites (Kalotermes spp., Incisitermes spp., Cryptotermes spp.), wood-destroying beetles, fungi, or other wood-destroying organisms unless stated specifically on the service contract.

C.     CHANGE IN LAW

Advanced Pest Innovations LLC conducts its services in compliance with federal, state, and local laws. Any changes to applicable laws may result in revised service charges or termination of this agreement. Except as prohibited by law or public policy, Advanced Pest Innovations LLC disclaims liability for direct, indirect, special, incidental, consequential, exemplary, punitive, or loss-of-enjoyment damages. The obligations specified herein are in lieu of all other obligations or representations, whether express or implied, including warranties of merchantability or fitness for a particular purpose.

6. NO SHOW FEES

A minimum fee of $50 will be charged for any scheduled service that cannot be completed due to lack of proper access to the property or the absence of a resident or tenant during the agreed-upon service window. This includes, but is not limited to, locked gates, inaccessible units, or failure to provide entry instructions. This fee is non-refundable and will be billed to the customer’s account. Repeated no-shows may result in cancellation of service at the discretion of Advanced Pest Innovations LLC.

7. ENTIRE AGREEMENT

This agreement, including these terms and conditions and the inspection graph, constitutes the entire agreement between the parties. No other oral or written representations shall bind the parties.

8. PESTICIDE LABELS

Upon request, Advanced Pest Innovations LLC will provide the purchaser with a copy of the manufacturer’s specimen label for the pesticide(s) used to treat the premises.

9. ELECTRONIC ACKNOWLEDGMENT

Pest control companies are required to provide records whenever a pesticide product or pest control system is applied. These records, which may include precautionary information, must be provided to the property owner, occupier, or custodian of the property. By signing the contract, the customer acknowledges and requests that pesticide use records be provided electronically or made available online.
